CM/ECF Updates Re: Order of No Discharge; Certificate of Services re: Plan Notices; Trustee Request for Relief from Abandonment; Event Links to Forms, Local Rules, Etc.

The following CM/ECF updates will take effect the weekend of January 9, 2017:

Order of No Discharge
The Notice of No Discharge that the court previously issued for failure to file financial management certifications and chapter 13 discharge related documents is being replaced with an Order of No Discharge. Debtors will need to seek relief from the order before they can file documents and receive a discharge.

Notice of Change in Time to File Certificate of Service for Amended Plan

Effective January 9th the Court will be looking for certificates of service concerning Chapter 13 plan distribution by debtors 3 days after the direction to service. More Info

New Court Security General Order and Public Notice

The Chief Judge of the District Court has signed a revised General Security Order, which became effective 12/19. The most important change is that prohibited items brought to the courthouse will not be held but will be confiscated and destroyed. For further details, click here.

CM/ECF Update Re: Relief from Abandonment

Relief from Abandonment

If a trustee seeks relief from abandonment to pursue possible assets, a Motion for Relief from Abandonment with a 14-day objection notice to affected parties must be filed. After the motion is granted, a Report of Possible Assets may be filed.

Notice of Amendments to Local Rules, Changes to Local Forms, and Fee Increases

The following CM/ECF updates will take place the weekend of November 26, 2016:

Updated Fees Effective 12/1/2016
Fees have been updated to match the new fees effective 12/1/2016. An updated Fee Chart is available on the court’s website.

Notice Language Updated re: Filing of Objections
Objection notices issued by the court have been updated to include more detailed language about filing of objections. The following notices have been updated:

General Order 16-0005: Order Amending Local Bankruptcy Rules

Notice of proposed amendments to the local rules of this Court was given to the bar and the public on November 4, 2016. The last date for submitting comments concerning the proposed amendment was November 22, 2016. More Info

CM/ECF Updates Re: eWOC & eFinCert Programs & New Adversary Filing Pertaining to Demand Amounts

eWOC and eFinCert Programs Updated
The eWOC (Electronic Withdrawal of Claim) and the eFinCert (Electronic Financial Management Certificate) programs have been updated to collect filer information (e.g., filer name, phone number, and e-mail address) and standardize docket text to include the filer information.
