General Information

The Means Test/Statement of Current Monthly Income must be filed with the Petition or within 14 days of filing.

Median family income information for use in completing the Chapter 7 Statement of Current Monthly Income and Means Test Calculation is available on the web site of the US Department of Justice.

Filing Requirements

Chapter 7 Statement of Current Monthly Income and Means Test Calculation (Form B22A) is required for all Chapter 7 individual debtors.

Chapter 13 Statement of Current Monthly Income and Calculation of Commitment Period and Disposable Income (Form B22C) is required for all Chapter 13 cases.

Chapter 11 Statement of Currently Monthly Income (Form 22B) is required for all Chapter 11 individual debtors.

The document must be filed as a separate document, not included in the same PDF as the Petition. However, if filing the balance of the petition on a case filed as an emergency, the Means Test/Statement of Current Monthly Income can be filed in the same PDF as the balance.

The document must be filed using the correct official form, and must be signed by the debtor(s).

Step-by-Step Procedures:

Log into CM/ECF
Select Bankruptcy > Schedules/Statement of Financial Affairs/Initial Required Documents
Enter case number (e.g., xx-xxxxx). Click Next
Select one of the following from the event list (according to chapter of case) and click Next:

- Ch 7 Statement of Current Monthly Income and Means Test (B22A)
- Chapter 13 Statement of Current Monthly and Disposable Income (B22C)
- Chapter 11 Statement of Current Monthly Income (B22B)

External Users Only: Check box if jointly filing with another attorney, click Next. If jointly filing, select additional attorneys, click Next

Select the party filer. If the party is not listed, click on Add/Create New Party

Note: The "Attorney/Party Association” screen may appear. If your party selection was correct, check the box to create an association.

Browse to select the document (pdf file). Click Next
Chapter 7 cases only: Answer question re: Presumption of abuse. Click Next. Debtor is claiming exclusion as a member of the National Guard or Reserves. Which answer should be chosen?
Enter current income of individual debtor(s). Click Next
Verify the final docket text; if correct, click Next

Note: Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

If debtor is claiming exclusion as a member of the National Guard or Reserves (if the box on revised Official Form 22A labelled "The presumption is temporarily inapplicable" was checked), docket a Statement of Debtor's Temporary Exclusion from Means Test.

Curing a Deficient Filing:

If the Application is deficient: An amended pleading that cures the deficiencies must be filed prior to the deficiency deadline using the above procedure or the bankruptcy case may be dismissed.
