If a surplus remains after all allowed claims have been paid in full, or if no claims have been filed, the trustee may request an extension of time for the filing of claims against the surplus.
Upon filing of the report, the court will enter an order extending the deadline to file a proof of claim. The trustee is responsible for distribution of this order then filing a certificate of service with the court.
Filing Requirements
The Report must be signed by the trustee.
No proposed order is required - the court will prepare one.
1. Log into ECF
2. Select Bankruptcy > Trustee/US Trustee
3. Enter case number (in the format xx-xxxxx) and click Next
4. Select Surplus Funds and Request for Extension of Time to File Claims, Report of from the event list and click Next
5. Click Next.
6. If you are filing jointly with another attorney, select that attorney. Click Next
NOTE: You cannot add attorneys. Only attorneys who have previously entered an appearance will be available for selection.
7. Select the party filer. If the party is not listed, click on Add/Create New Party. Click Next
Note: The "Attorney/Party Association” screen may appear. If your party selection was correct, check the box to create an association and click Next.
8. Browse to select the Report (pdf file). Click Next
9. A message is displayed re: service of the order. Click Next
10. Final docket text is displayed. Click Next
11. Verify final docket text. If correct, click Next to submit
Curing a Deficient Filing:
If the Report is deficient: A new report, fixing deficient items, must be filed prior to the deficiency deadline or your original filing may be stricken by the court.
