Motion to Extend Exclusivity Period (Chapter 11 Plan and/or Disclosure Statement)

Only the debtor may file a plan during the first 120 days after filing the petition. A debtor’s request to extend this exclusive time period may be granted after hearing and notice.
If the debtor has filed a plan which has not been confirmed within 180 days of filing the petition, they may ask for an extension of this exclusive period, which may be granted after hearing and notice.
Select Bankruptcy > Motions/ Application
Enter case number. Click Next
Select Extend Exclusivity Period - Ch 11 Plan/Disclosure Statement. Click Next
Click Next. Or, if joint filing with another attorney, check box and click Next.
Select party and click Next. If party is not listed click Add/ Create New Party
Go to step 8 or, if the attorney/ party association screen appears, click here for more information
Browse to select correct .PDF file. Click Next
Select appropriate radio button and click Next
If applicable, select prefix text and/ or insert text in text box. Click Next
Verify final docket text. If correct, click Next to submit and to review Notice of Electronic Filing
Curing a Deficient Filing:
If the Motion is deficient: A corrected motion, using ECF event Extend Exclusivity Period, fixing deficient items, must be filed prior to the deficiency deadline or the original filing may be stricken by the court.
