Notice of Revised General Order Expanding Mortgage Loss Mitigation Procedure to All Divisions -- (July 14, 2016)

Chief Judge Robyn Moberly, acting on behalf of the Court, has signed General Order 16-0002, which replaces General Order 14-0002. The general order has been posted to the Court’s website. A link is here:

This general order becomes effective July 18, 2016. It expands the mortgage loss mitigation program, used in New Albany, to all divisions but with several significant changes. Those changes include eliminating required use of a “portal” and a mediator but allowing the parties to use either. Other changes clarify the process and the rights of the parties during that process.

The changes to the procedure required changes to several of the CM/ECF events used. The general order names the pertinent events. All events can be found in the Mediation and Loss Mitigation menu (previously the “Mediation/Alternative Dispute Resolution” menu). A flow chart showing the new process, with pertinent deadlines, is available in the Procedures Manual, at the Mediation and Loss Mitigation chapter – labeled “Loss mitigation flow chart.”

The general order applies in all cases, even those in which the mortgage loss mitigation process was commenced under the prior general order. (The CM/ECF events used in the earlier procedure remain – but have been renamed to remove reference to ‘mediation’ since that is no longer required.)
